these terms apply to one-time purchases of scripts, plugins, and other downloadable music-production tools sold under the SHMLV (shmlv.) brand. by buying, downloading, installing, accessing, or using a product, you agree to these terms.
SHMLV (shmlv.) is the brand of Denis Shumilov, the independent developer and licensor based in Ukraine.
how these terms work
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
the product name, one-time price, main deliverables, and compatibility information are shown before payment. unless a product page and checkout explicitly say otherwise, a purchase is a one-time payment and not a subscription. before paying, you must accept the current terms & conditions and refund policy.
purchases completed through Payhip before the move to Paddle remain valid. Payhip is retained only for those legacy orders, receipts, and related billing or refund records; it is not the checkout provider for new purchases.
these terms govern your license to use the product and your relationship with shmlv. as the developer and licensor. if a product page or download package includes product-specific terms, those terms supplement these terms.
license grant
subject to these terms and payment of the applicable price, you receive a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the product for your own personal use or your own internal business use.
- unless a product page says otherwise, one purchase means one user.
- you may install and use the product on a reasonable number of devices that you own or control, as long as the product is used only by you.
- you may use the product in your own music, audio, midi, production, and client work, including commercial releases.
- you may make reasonable backup copies for your own use.
- you owe no royalties to shmlv. for creative output made with the product.
restrictions
- do not share, resell, redistribute, gift, assign, sublicense, rent, lease, lend, or upload the product or included files.
- do not make one purchase available to multiple users, a team, a studio, or a classroom unless that license is explicitly offered.
- do not post the product publicly or privately for download, including in forums, discord servers, cloud drives, template packs, or file-sharing sites.
- do not remove copyright, trademark, attribution, or license notices.
- do not copy, extract, adapt, or reuse protected product files, code, or content to create a competing or derivative commercial product.
- do not reverse engineer, decompile, or disassemble the product except where this restriction cannot legally be enforced.
ownership
the products are licensed, not sold. shmlv. keeps all intellectual property rights in the products. shmlv. does not claim ownership of the music or other creative output you make with a product. all third-party names, daw names, and trademarks remain the property of their respective owners.
digital delivery
after Paddle confirms a successful one-time payment, shmlv. begins electronic fulfillment and Paddle sends the transaction receipt. delivery may include a download email, access through your shmlv. account, or both. you are responsible for providing an accurate email address, checking spam folders, keeping a copy of your receipt, and making sure your system meets the stated requirements before purchase.
- if account access is available, your account may show owned downloads, beta access, and recovery tools.
- account access is provided as a convenience and does not change the license restrictions in these terms.
- private download links, beta access, and short-lived download tokens are personal to you. do not share them.
updates and support
whether updates are included is stated on the relevant product page. unless explicitly stated otherwise, shmlv. does not promise lifetime updates, future features, or compatibility with every future DAW version. support is available via [email protected].
refunds
refunds are governed by the refund policy, Paddle's buyer-facing terms for Paddle orders, the applicable legacy Payhip terms for earlier Payhip orders, and mandatory law. Paddle handles payment-related return and refund processing for Paddle orders. if a refund or chargeback is granted, your license to use the refunded product ends immediately and you must stop using it and delete all copies.
disclaimer and liability
to the maximum extent permitted by law, products are provided as-is and as available. shmlv. does not guarantee that every product will be uninterrupted, error-free, or fit for every workflow or unsupported configuration. total liability relating to a product is limited to the amount paid for that product, except where liability cannot legally be limited or excluded.
termination and changes
if you breach these terms, your license ends automatically and you must stop using the product and delete all copies. shmlv. may suspend account access, private downloads, or beta access if needed to protect the service, prevent abuse, process a refund, comply with law, or enforce these terms. these terms may be updated from time to time; the version posted on the site at the time of purchase applies to that purchase.
governing law and contact
except to the extent mandatory consumer law says otherwise, these terms are governed by the laws of Ukraine. this does not remove any mandatory rights you may have under the law of your country of residence. contact: Denis Shumilov, Kyiv, Ukraine, [email protected].
